New Deficiency Judgment Rules in Maryland

Deficiency judgment rules in Maryland are about to change, thanks to the passage of a new law in the recent legislative session. A deficiency judgment is the process by which a lenders seeks payment for any funds that weren’t accounted for in a foreclosure sale. As an example, if a home is valued at $100,000, and sells for $75,000 in a foreclosure sale, the lender can seek a deficiency judgment to file for the additional $25,000 in value that the sale didn’t bring.

Previously, the lender had up to 12 years to file a deficiency judgment and collect this outstanding mortgage debt. This extended timeline made it difficult for homeowners who had been through foreclosure to move on, as they could never be sure if the lender would seek a deficiency judgment 5, 10, or even 12 years out.

The new law shortens this timeframe significantly, reducing it from 12 years to 3 years. The new law also makes a deficiency judgment the only method by which a lender can seek payment on an outstanding mortgage. The law will go into effect on July 1, 2014. Another bill which would have put a halt on all foreclosures in the state for 6 months did not pass.

Maryland Foreclosure Rate Second Highest in U.S.

It’s a story that has been told time and time again in recent years in the world of Maryland real estate, and though the numbers are still high, there are some small signs of potential improvement. The numbers for foreclosure rates last month released by RealtyTrac (which tracks all 50 states’ foreclosure rates) showed that Maryland had the second highest foreclosure rate in the country, second only to Florida. In addition, Maryland’s biggest metropolitan area, Baltimore-Towson, “had the third highest foreclosure rate of the major metro areas behind Tampa-St. Petersburg and Miami-Fort Lauderdale in Florida,” according to the Baltimore Sun.

While Maryland is still in high water, much of the rest of the nation seems to have passed the foreclosure crisis, with the national foreclosure rate at its lowest level in more than 7 years. Foreclosure starts nationwide were at their lowest level in more than 8 years. In Maryland, foreclosure starts (the beginning of the foreclosure process) were up 15% year-over-year, but dropped 6% when compared to January, falling for the second month in a row.

While this may be a sign of good things to come, the fact remains that many Marylanders are facing foreclosure. There were 2,210 foreclosure starts in the state last month, and many of these homeowners are searching for a fast solution.
